Rules and standards of case reception in proceeding in company:
- Company starts legal proceeding after analyze of case’s factual and legal circumstances, characterization perspectives of case and verification of client’s credibility.
- Company will only start legal proceeding after consent of company’s CEO if case belong to the category of hard spheres
The company will not receive cases in proceeding in the following occasions:
- IF case has no perspective after checking legal and factual evidences
- If there is court decision which is in legal force and there is no evidence and substantiation for renew the case.
- If case is ongoing in the courts or in administrative organs and legal representation is carried out by another company and / or lawyer.
- If the trial is completed in one of the instances of common courts and litigant insists representation to continue in one of the court instances;
The company will receive cases in proceeding by way of an exception in the following occasions:
- If legal proceeding on case is litigants’ legal interest to arise preconditions for another legal outcome or begin another legal proceeding. In this case, the company is obliged to explain the risks and expected results to the litigant which can be reflected in the contract or in the form of a separate agreement.
- If case is produced in administrative bodies by another representative and hence from company’s nice strategy and circumstances of the case it has justified assumption of success in common courts;
- If the cost of the subject of litigation is less than the cost of legal services but it is special interest of litigant;
- If case was proceeded by the litigant in the common courts or in administrative bodies without representative authority;
- If litigation is completed in one of the instances of general courts and by continuing representation in another instance company argues the success of the case.
Standards and rules of the relationships with company clients:
- After starting the case legal proceeding company is obliged to inform client about case strategy, cost of the service, contractual conditions, sign a service agreement and authorization / power of attorney.
